Privacy Policy

ModernCloudCore (“we”, “us”, “our”) respects the privacy of clients, prospects, and website visitors. This Privacy Policy explains how we collect, use, store, and protect personal data when you visit moderncloudcore-related properties, submit inquiries through our contact channels, or engage our cloud infrastructure services.

1.1 Data Controller

1.2 Categories of Data We Collect

  • Identity & contact data: name, organization, email address, phone number you submit via inquiry forms or direct correspondence.
  • Project & commercial data: architecture requirements, stack details, budget ranges, and statements of work shared during scoping.
  • Technical data: IP address, browser type, device identifiers, pages viewed, and approximate location derived from standard server logs.
  • Usage data: cookie identifiers, session tokens, and diagnostic telemetry used to secure and improve platform operations.

1.3 Legal Bases (GDPR)

We process personal data under the following legal bases under Regulation (EU) 2016/679: performance of a contract or pre-contractual steps at your request; legitimate interests in operating and securing our infrastructure services; consent for non-essential cookies and marketing communications (withdrawable at any time); and legal obligations where applicable.

1.4 Purposes of Processing

  • Responding to inquiries and preparing architecture proposals.
  • Delivering contracted cloud engineering services and managing client relationships.
  • Processing payments through our payment processor.
  • Securing our website, APIs, and control-plane systems.
  • Complying with tax, accounting, and regulatory requirements in France and the EU.

1.5 Data Retention

Inquiry and project data are retained for the duration of the engagement plus up to five (5) years for contractual, accounting, and legal purposes. Technical logs are retained for up to twelve (12) months unless needed longer for security investigations. You may request earlier deletion where no overriding legal basis applies.

1.6 Recipients & International Transfers

Personal data may be shared with trusted processors hosting our email, hosting, and payment systems, bound by data-processing agreements. Where data is transferred outside the European Economic Area, we rely on Standard Contractual Clauses or other approved safeguards under Chapter V of the GDPR.

1.7 Your Rights

Subject to applicable law, you may request access to your personal data, correction, erasure, restriction of processing, data portability, and object to processing based on legitimate interests. You may also lodge a complaint with the Commission Nationale de l'Informatique et des Libertés (CNIL), the French supervisory authority.

1.8 Security

We implement technical and organizational measures including encryption in transit, access controls, network segmentation, and least-privilege practices appropriate to the sensitivity of infrastructure and client data.

Terms of Service

Governing agreement for ModernCloudCore engagements

These Terms of Service (“Terms”) govern access to the ModernCloudCore website and the provision of cloud infrastructure consulting, architecture design, platform engineering, and related services by ModernCloudCore, 2 Chemin de Lafont, 33450 Saint-Loubès, France (“ModernCloudCore”, “we”, “us”). By engaging our services or using this site, you agree to these Terms.

2.1 Services & Scope

ModernCloudCore provides professional services including but not limited to multi-region cluster design, Kubernetes platform engineering, elastic compute architecture, observability stacks, security hardening, migration planning, and infrastructure-as-code baselines. Specific deliverables, timelines, and acceptance criteria are defined in each Statement of Work (SOW) or order summary.

2.2 Proposals & Engagement

A proposal or invoice summary becomes binding upon your written acceptance or payment. We may decline work that conflicts with security policies, capacity constraints, or legal requirements. Engagement timelines assume timely client feedback, access credentials, and environment access; delays caused by the client may shift delivery dates.

2.3 Client Responsibilities

  • Provide accurate information regarding systems, data sensitivity, and operational constraints.
  • Grant legitimate access to repositories, cloud accounts, and stakeholders as needed.
  • Maintain backups of critical data and apply changes in staging environments where recommended.
  • Ensure they have authority to engage ModernCloudCore on the contracting entity’s behalf.

2.4 Fees & Payment

Fees are stated in proposals and invoices. Payments are due according to the schedule in the applicable SOW. Payment links provided on this site process transactions through third-party payment providers; ModernCloudCore does not store full card numbers. Late payments may accrue interest at the maximum rate permitted by French law and may pause non-critical work.

2.5 Intellectual Property

Upon full payment of the applicable engagement fees, ModernCloudCore assigns to the client the intellectual property rights in client-specific deliverables (architecture documents, custom modules, and configurations) excluding any pre-existing tools, frameworks, templates, or methodologies. ModernCloudCore retains ownership of generic know-how and reusable tooling.

2.6 Confidentiality

Each party agrees to protect the other’s confidential information with at least reasonable care and to use it solely for the purposes of the engagement. These obligations survive for three (3) years after termination, or longer where required for trade secrets.

2.7 Service Levels

Availability and support guarantees are only those expressly committed in a written SOW. Unless otherwise stated, website content and non-contracted materials are provided “as is.” We disclaim implied warranties to the fullest extent permitted by applicable law.

2.8 Limitation of Liability

To the maximum extent permitted by law, ModernCloudCore’s aggregate liability arising out of an engagement shall not exceed the total fees paid by the client for the services giving rise to the claim in the twelve (12) months preceding the event. Neither party is liable for indirect, incidental, special, or consequential damages. Nothing in these Terms limits liability that cannot be limited under applicable law.

2.9 Termination

Either party may terminate an engagement for material breach if the breach remains uncured fifteen (15) days after written notice. ModernCloudCore may suspend work immediately where continued delivery would compromise security, legality, or network stability. Provisions on payment for work performed, confidentiality, IP, and liability survive termination.

2.10 Governing Law

These Terms are governed by the laws of France. Disputes shall be submitted to the competent courts of Bordeaux, without prejudice to mandatory consumer protections.

Refund & Reimbursement Policy

Commercial terms for ModernCloudCore professional services

ModernCloudCore is committed to fair commercial practices for professional infrastructure services. This Refund & Reimbursement Policy explains when refunds may be issued, how deposits and progress payments work, and how reimbursements are handled. It applies to engagements contracted by ModernCloudCore, 2 Chemin de Lafont, 33450 Saint-Loubès, France.

4.1 Non-Refundable Deposits

A deposit or kickoff payment reserves engineering capacity and funds preparatory work (discovery, architecture spikes, and environment reviews). Once work has commenced, deposits are non-refundable unless ModernCloudCore cancels the engagement before substantial work has begun.

4.2 Progress Payments

Milestone invoices are due as work is delivered. If a client terminates an active engagement for convenience, fees are owed for all work performed and non-cancellable third-party costs incurred up to the termination date. Unearned prepaid amounts beyond completed milestones may be refunded on a pro-rata basis within thirty (30) days of written termination notice.

4.3 Service-Level Deficiencies

If a delivered milestone fails to meet an explicit acceptance criterion defined in the SOW, and ModernCloudCore cannot cure the deficiency within a reasonable period after written notice, the client may request re-performance or a proportional refund of the fee allocated to the deficient milestone. This remedy is the client’s primary recourse for service-quality issues.

4.4 Website & Payment Portal

Payments made through our payment links settle against a specific invoice or engagement. If you believe a payment was made in error, contact [email protected] with the transaction reference and your organization name. Valid duplicate or erroneous charges will be reviewed and refunded where confirmed.

4.5 Client-Caused Delays

Where delivery stalls due to missing access, unresolved questions, or unapproved change requests, ModernCloudCore may extend timelines and invoice non-cancelable reserved capacity. Refunds are not available for time reserved but blocked by the client unless agreed otherwise in writing.

4.6 Chargebacks

Please contact us first to resolve billing questions. Filing a payment dispute without prior communication may pause further work while the matter is resolved with the payment provider.

4.7 Legal Consumer Rights

Nothing in this policy limits mandatory rights you may have under applicable French or EU consumer law. Where such rights conflict with this policy, the mandatory legal rights prevail.
